Licence of Occupation
A License of Occupation is a formal agreement between the City of Lloydminster and Applicant, that grants the Applicant permission for the purpose of placing an encroachment on a select portion of the road right-of-way.
An encroachment shall be considered as anything placed, constructed, or erected on or above the ground that extends into or is placed within the road right-of-way, most commonly being a temporary sign or bench.
The road right-of-way, for the purpose of where encroachments may be placed under this guideline, is the land between the edge of the travelled roadway and the property line/public utility line.
- A completed application form;
- Location map or site plan - plans shall be an aerial view outlining the property lines, setbacks, utility right-of-way, and distances.
- Application fee - $200 per encroachment per annum;
- Review the application
- Consider the proposed location, including but not limited to, setbacks from the curb, edge of sidewalks and walking trail, municipal infrastructure or servicing and other license of occupation locations.
- Determine adjacent land uses.
- Review existing and/or potential safety concerns.
- Forward the proposal to affected internal departments for review.
During the review process, additional information may be requested by the City to make a final decision. At their discretion, City Administration may also impose additional requirements or restrictions on the final placement or nature of the proposed location to mitigate impact or issues to the surrounding properties and community.
Process if Application is Deemed Approved:
- The City will prepare a License of Occupation agreement and email it to the address indicated on the application for review.
- Documents will be executed once the Applicant meets all requirements and a certificate of insurance is provided to the City.
- Once signed by both parties, the Applicant will receive an executed License of Occupation agreement and may commence erection of the encroachment in accordance with the commencement date and terms and conditions outlined in the agreement.
Process if Application is Deemed Refused:
- The City retains the authority to approve or not approve any request for a License of Occupation.
- If the application is refused, the application fee shall not be refunded.
- According to Bylaw 29-2022, use of the land without authorization will result in enforcement by the City of Lloydminster.
- Dependent on the reason for the refusal, the Applicant may propose an alternate location nearby.
You may apply for up to five (5) separate encroachments per application.
**Completing an application does not permit an Applicant to commence installation**
